A leading female QC is seeking to change aspects of law that relate to women. She feels women are treated as second class citizens and men make too much of 'women and their hormones'. Curiously the changes she proposes would remove certain defenses to criminal acts committed by women, e.g: Infanticide: Is the deliberate killing of a child under the age of twelve months although deaths usually occur within hours or minutes of life. It must be shown that the infant had a separate existence and death occurred as a result of of an act of either deliberate commission or omission. The Infanticide Act 1938 allows courts to take a 'lenient' view of the nother who kills her infant 'while the balance of her mind was disturbed by reason of not having fully recovered from the effects of giving birth or by the reason of lactation consequent upon the birth of the child'. The female barrister suggests that the predominately male law makers and judges have always felt that women are victims of their hormones and unable to control their mind rationaly. I would be interested to hear other folks views about this potential change in the law and the 'women and their hormones' concept! |
